USER AGREEMENT
This USER AGREEMENT (the “Agreement”) is made and entered into by and between StarScript Ltd, a Nevada Limited Liability Company, (“StarScript”) and any person who creates an account with, visits, or views to the www.StarScriptLegends.com website (“User”).
Section 1: Terms & Conditions
1.1 Intellectual Property. All copyright, trademarks, design rights, content, visual media, devices, methods and the like displayed online on the www.StarScriptLegends.com website, or any derivations thereof, (“Site”) are the private intellectual property of StarScript, which is protected by copyright law, except content that is originated by Users, which is their property alone to the extent such ownership does not conflict with the rights of others as provided by law.
1.2 Products and Services. All Intellectual Property offered on the Site are Products and Services provided to Users whether they are offered for free or for a price by StarScript in exchange for a right to use them.
1.2 Limited License. Users have a limited license to view the StarScript Intellectual Property, to input data on their StarScript User profile page, and use the Site’s social functions like follow/unfollow, friend, private messenger, notifications, member search, and forums to connect with other users.
1.3 Links to other Websites. StarScript is not responsible for any event that occurs as a result of a User clicking on third party links posted by other Users. Users are responsible for reading the Terms and Conditions and Privacy Policies of those third parties.
1.4 User Duties. Users promise to refrain from posting any derogatory, profane, slanderous, or harassing content that would in any way violate United States or Nevada Law. User further promises to only publish content that he/she originated, and shall not post any content that violates United States or Nevada law.
Section 2: Warrants
2.1 LEGAL AGE. Backer warrants that he or she is at least 18 years of age at the time of accepting and executing this Agreement.
Section 3: Limitation of Liability
3.1 DISCLAIMER OF WARRANTIES. All Services are provided “as is” and “as available,” at the sole risk of the User. StarScript expressly disclaims all implied or express warranties, including without limitation, the implied warrants of merchantability, fitness for a particular purpose, title, and non-infringement. StarScript makes no warranty that the Services will meet any of the User’s need, that use of the foregoing will be uninterrupted, timely, secure, or error-free, that the results obtained form the use of the foregoing or any information found thereon will be accurate or reliable, or that the quality of any content, products, services, information, or other material provided to the User will meet their expectations.
StarScript does not control or direct what Users do or say, and is not responsible for User’s
actions or conduct (whether online or offline) or any content they share (including offensive,
inappropriate, obscene, unlawful, and other objectionable content).
User understands that there may be other risks involved with Use of the Services, which are not specifically identified in this Agreement.
3.2 Neither StarScript nor its affiliated companies or their respective officers, directors, agents, or product users be liable under contract, tort, strict liability negligence, or any other legal or equitable theory with respect to Legends for any of the following:
- Lost profits, data loss, cost of procurement of substitute goods or services, or special, indirect, incidental, punitive, or any consequential damages of any kind whatsoever;
- Bugs, viruses, Trojan horses, or the like, (regardless of source of origination); or
- Direct damages in excess of $100 dollars.
SOME STATES OR COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND
EXCLUSIONS MAY NOT APPLY TO BACKER.
Section 4: Jurisdiction
4.1 JURIDICTION. This Agreement shall be construed and enforced in accordance with, and the rights of the parties shall be governed by, the laws of the State of Nevada as determined herein.
Section 5: Amendments
5.1 AMENDMENTS. This Agreement may be amended by StarScript from time to time for any reason, or no reason at all. In order for any amendment to take effect, StarScript must publish the same on StarScriptLegends.com.
Section 6: Term
6.1 TERM. The effect of this Agreement shall continue on in perpetuity or for the maximum amount of time allowable by law, unless otherwise terminated by mutual agreement of the parties.
Section 7: Execution
7.1 EXECUTION. By viewing, creating an account, or otherwise using StarScript's Site, the undersigned executes this Agreement, warrants that she/he understands all terms and conditions stated herein, and with intention, accepts and completes the manifestation of mutual assent to those terms and conditions, thereby establishing an effective and enforceable legally binding contract. This Agreement may be executed by electronic signature.
